1. Terms and Conditions

These Terms of Use (“Terms”) are made between you, the end user of the Turkan Luxury Establishment website,

Changes in the law or the business and policies of Turkan Luxury may require changes to the Terms from time to time ("Modified Terms"), so Turkan Luxury urges you to review the Terms periodically to be aware of any such changes. You are responsible for carefully reading the Terms and the Site's Privacy Policy ("Privacy Policy") and agreeing to them each time you use the Online Store. You will also be notified each time the Terms change to accept the modified Terms before you can continue to purchase a product from the Online Store. Your continued use of the Website constitutes your acceptance of and compliance with the most recent version of the Terms. If you do not agree to (or are unable to comply with) the Terms, do not use this Online Store.

2. User Conduct and Content

You agree to comply with all applicable laws in the Kingdom of Saudi Arabia by using the Online Store, and you acknowledge that you bear full responsibility for ensuring that you have reviewed and complied with these requirements.

The Online Store may provide opportunities for users to post comments, other questions, suggestions, and other information (“User Content”) on or through this Online Store by email or telephone, or otherwise disclosed, submitted, or displayed in connection with your use of the Website. You warrant that any such User Content you submit to the Online Store is accurate (and does not infringe upon the intellectual property rights of others), and you hereby grant Turkan Luxury a perpetual, irrevocable, royalty-free right to use your User Content as Turkan Luxury may wish, including, without limitation, copying, modifying, deleting in its entirety, adapting, publishing, translating, creating derivative works from, selling, and/or distributing such User Content and/or incorporating such User Content into any form, media, or technology worldwide, without further reference to you, and you hereby waive any moral rights in such User Content. You also agree that you will not post any content that is contrary to public morals, defamatory, incites riots, constitutes an infringement of intellectual property rights, or may otherwise violate public morals or the law.

Turkan Luxury Establishment is not in any way bound by the following:

(1) maintain the confidentiality of any User Content;

(2) pay any compensation to a User for any User Content;

(3) respond to any User Content;

You agree that any User Content you submit to the Online Store will not violate the Terms or any third party right, including, but not limited to, copyright, trademark, privacy right(s), or other personal or proprietary rights, and will not cause injury to any person or entity. You further agree that any User Content you submit to the Site will not be libelous, defamatory, or otherwise unlawful, threatening, abusive, or obscene, and will not contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam."

Turkan Luxury does not regularly review posted User Content, but reserves the right (but is not obligated) to monitor, edit, or remove any User Content posted to the Online Store. You grant Turkan Luxury the right to use the name you submit in connection with any User Content. You agree not to use a false email address, impersonate any person or entity, or otherwise mislead as to the origin of any User Content. You agree to indemnify Turkan Luxury for any claims arising out of any User Content you submit. Turkan Luxury shall have no responsibility or liability for any User Content submitted by you or any third party.

3. Account and Registered User:

In order to purchase any products from the Online Store, you may either register on the Site and create a password-protected account (“Account”) or place an order without creating an account, i.e. as a “Guest”.

Any account you create is considered your personal account, and you may not transfer it to anyone else. Your registration or order (as a guest) is completed after you accept the Terms, and the Terms apply each time you place an order for any product via email.

- By registering and creating an account, you become a "Registered User." To become a Registered User or to place an order for any product from the Online Store as a Guest, you must be 18 years of age or older, provide true, accurate, current, and complete information about yourself in all its details (including name, date of birth, email address, credit card information, and other information), undertake to ensure that such information is kept up to date, and agree to handle such information in accordance with the Privacy Policy as required. If you are under 18, you may use this Online Store only under the supervision of a parent or legal guardian who agrees to be bound by these Terms. If you are a parent or legal guardian agreeing to these Terms on behalf of a person under 18, you assume full responsibility for their use of this Online Store, including any financial expenses and legal liability incurred by them.

Turkan Luxury Establishment reserves the right to refuse service, terminate accounts, or cancel orders at its sole discretion.

You are responsible for maintaining the confidentiality of your account and password and for restricting the use of your personal computer, mobile device, tablet, or other mobile or wireless device. You agree to accept responsibility for all activities that occur under your account and password. Turkan Luxury Establishment shall not be liable to any person for any loss or damage which may arise as a result of any failure by you to protect your password or account. If Turkan Luxury Establishment has reason to believe that there is likely to be a breach of security or misuse of the Online Store, we may require you to change your password or suspend your account without incurring any liability for this.

4. Services, purchase orders, pricing and payment:

Services include:

- Providing the online store for you to purchase any product from it.

- Delivery by Turkan Luxury Establishment, or securing a logistics company with experience in collecting, transporting and delivering the purchased products to you (“Logistics Services Supplier”).

- Turkan Luxury Establishment customer support, which will allow you to contact Turkan Luxury Establishment via customer phone or email to ask any questions you have regarding the product(s) you have purchased.

- If you choose to pay upon receipt, you agree to be contacted by customer service.

You agree to pay the full amount due for the Product as indicated during the purchase order process, including transportation costs and expenses incurred in connection with such purchase order.

- All prices are shown in Saudi Riyals.

- Turkan Luxuries will not accept your purchase of the products if:

(a) The product(s) is out of stock.

(b) Turkan Luxury has not been able to obtain payment authorization from you.

(d) If Turkan Luxury Establishment finds that there is an error in a product or in the price.

(e) For any other reason at Turkan Luxury's sole discretion. Turkan Luxury will, in any event, notify you of the non-acceptance of your purchase order, will not process the payment, and will not be liable to you or any third party for our decision to refuse to process the purchase order, cancel it, or suspend any transaction after the order has been processed.

- A transmission error may occur that may disrupt the purchase process. You agree to cooperate with Turkan Luxury to resolve these issues, and you agree that Turkan Luxury has full authority to make the appropriate decision in such cases.

All payments made via credit/debit cards are subject to validation by the issuing authority. If the issuing authority refuses to authorize payment, Turkan Luxury will cancel your order and contact you to arrange an alternative payment method. Turkan Luxury will not be liable if this results in a delay in the dispatch of your merchandise/products.

All information related to billing and registration must be true and accurate. Providing any incorrect or inaccurate information constitutes a breach of these Terms. By confirming your purchase at the end of the process, you agree to accept and pay for the product(s) ordered.

Certain purchase orders may constitute inappropriate use of the website and its services, and Turkan Luxury reserves the right, at its sole discretion, to refuse or cancel any purchase order for any reason. Turkan Luxury may, at its sole discretion, suspend or terminate your account for any reason.

- In the event that an incorrect price is listed for a product due to a pricing error, Turkan Luxury Establishment reserves the right, at its sole discretion, to refuse or cancel any purchase order placed for that product. In the event of an error in the pricing of a product, Turkan Luxury Establishment reserves the right, at Turkan Luxury Establishment's sole discretion, to either contact you for instructions or cancel your order and notify you of such cancellation.

Turkan Luxury will make reasonable efforts to offer attractive prices on the online store and in its branches. However, the price of a product available online may differ from the price available in its traditional (offline) stores.

- Turkan Luxury reserves the right, in its sole discretion, to limit the number of items purchased per customer, per household, or per order. These limits may apply to orders placed by the same account or credit card, as well as to orders that use the same billing or shipping address.

5. Shipping

In order for Turkan Luxury to take the necessary steps to deliver any products you have purchased to you, you are solely responsible for providing correct and accurate postal information.

The risk of loss and ownership of the products you purchase through the online store are transferred to you upon receipt of the products you purchased from the logistics provider or a representative of Turkan Luxury Establishment.

- Turkan Luxuries shall not be liable for any delays in shipping the product(s) you have ordered or purchased, or for lost or mislaid product(s), or for product(s) delivered to you improperly, as a result of an error on your part or due to inaccuracy, incorrectness or incompleteness of the information you have provided.

- All products are quality controlled and inspected for defects before being dispatched to you. If you receive a product that is not in perfect condition, please write to us immediately and arrange for the defective product to be returned to us.

6. Returns:

- Turkan Luxury Est. wants you to have a successful shopping experience. If for any reason you are not completely satisfied with your purchase, Turkan Luxury Est. will refund your purchase within thirty (30) days of delivery of your purchased products. Returned products must be new, unused, in their original packaging, accompanied by the original invoice, and with all product tags still attached. Turkan Luxury Est. may not accept returns that are damaged, soiled, or altered and may be sent back to you.

- The value of all returned products will be properly refunded to the original owner and credited to the relevant credit/debit card or transaction bank account less applicable bank charges (if applicable). If you discover an error in the value of the purchases refunded to you, please write to us.

- Please note that refunds for card purchases may take up to thirty (30) business days for your bank to complete the process, depending on the processing time. This period may vary significantly between card issuers. Therefore, Turkan Luxury will not bear any responsibility for any delays in refunding payments by card issuers. Turkan Luxury does not provide any guarantees of any kind regarding the accuracy of refunds or the timing of their arrival to the customer’s card/bank account, due to the multiplicity of institutions involved in processing online transactions, problems with the internet infrastructure currently available, and working days/holidays of financial institutions.

7. Privacy:

While using the Website, we will collect certain information from you (“Information”) which will be handled in accordance with the Privacy Policy.

8. Disclaimer and Warranties:

- To the maximum extent permitted by law, Turkan Luxuries does not guarantee that the online store or any of the services or products available through it will continue to operate or be error-free. Some materials or services available through the online store may be delayed, error-free, malfunction, or inaccurate. Turkan Luxuries does not guarantee that the services will meet any specific standards of performance or quality.

- Turkan Luxury Establishment makes no representation or warranty regarding the accuracy, completeness, timeliness, reliability or non-infringement of any content available on the Online Store or services available through it.

- Although Turkan Luxury Establishment intends to take reasonable steps to prevent the introduction of any viruses, worms or malicious code to the Site, Turkan Luxury Establishment does not represent or warrant that the Online Store or the services, features or materials that may be made available through the Online Store are free from destructive features, and Turkan Luxury Establishment shall not be liable for any damages or harms resulting from such features.

Accordingly, Turkan Luxury does not guarantee the security or confidentiality of any information you transmit to the online store, and cannot verify such security. Therefore, transmitting any information to the online store is at your own risk.

Turkan Luxury makes no representations or warranties of any kind, express or implied, regarding the operation of the online store or the services, information, content, materials, or products included in this online store, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, merchantability, security, accuracy, or non-infringement, without limiting the foregoing. You acknowledge, by using the Turkan Luxury website, that your use is at your sole risk. This disclaimer does not apply to any product warranty provided by its manufacturer. - Product information viewed through this online store is obtained from claims made by the product's manufacturer/supplier. 11. Important information:
